Impacts of Airey v. State of New York on Solar and Wind Real Property Tax Assessment

The Supreme Court, Albany County, granted petitioners relief holding that RPTL section 575-b was unconstitutional as an impermissible delegation to the Department of Taxation and Finance of the Legislature’s taxing power. The case is pending appeal by the State.
